Effective from April 1, 2026
1.1. These Terms of Service (hereinafter "Terms") govern the rights and obligations between the operator of LoveMyStudio (hereinafter "Provider") and the user of the service (hereinafter "Photographer").
1.2. The Provider is Michal Pavlásek, ID: 47342391, registered at V Teničkách 613, Uherské Hradiště, Czech Republic, email: support@lovemystudio.com.
1.3. LoveMyStudio is an online platform designed for professional photographers and photography studios to manage clients, assignments, previews, orders and delivery of finished photographs.
2.1. The service is intended exclusively for business entities (photographers, studios).
2.2. By registering, the Photographer confirms they are over 18 years of age and authorized to act on behalf of the registered entity.
2.3. The Photographer is obliged to provide truthful and complete information. The Photographer is responsible for the accuracy of the data.
2.4. The Photographer is responsible for securing their password and login credentials.
3.1. After registration, the Photographer receives a 30-day free trial with full access to all features.
3.2. After the trial period, a paid plan must be selected to continue using the service.
3.3. Current pricing is available at /pricing. Prices are listed excluding VAT unless stated otherwise.
3.4. Subscriptions automatically renew for the next period unless cancelled before the end of the current period.
3.5. Cancellation is possible at any time through the customer portal. After cancellation, the account remains active until the end of the paid period.
4.1. The Photographer agrees to use the service in compliance with applicable laws, in particular GDPR (EU Regulation 2016/679).
4.2. The Photographer is the data controller in relation to their clients. The Provider acts as a data processor based on these Terms, which also constitute a Data Processing Agreement (DPA).
4.3. The Photographer must not upload content that violates the law, infringes third-party rights, or is otherwise objectionable.
4.4. The Photographer is responsible for having a legal basis for processing their clients' personal data (consent, contract, etc.).
5.1. The Provider commits to ensuring service availability of at least 99% per month (excluding scheduled maintenance).
5.2. The Provider performs regular data backups but is not liable for data loss caused by force majeure or the Photographer's actions.
5.3. The Provider reserves the right to suspend or terminate the Photographer's account in case of violation of these Terms.
5.4. The Provider reserves the right to modify these Terms. The Photographer will be notified by email at least 30 days in advance.
6.1. The Provider processes personal data of the Photographer's clients solely for the purpose of providing the service and based on the Photographer's instructions.
6.2. Processed data: first name, last name, email, phone, photographs, orders.
6.3. The Provider has implemented technical and organizational measures to protect personal data (encryption, backups, access control).
6.4. The Provider does not share personal data with third parties except for the payment provider Stripe (for payment processing).
6.5. After termination of the service, the Photographer's and their clients' data will be deleted within 30 days, unless the Photographer requests an export.
7.1. The Provider is not responsible for content uploaded by the Photographer or for the relationship between the Photographer and their clients.
7.2. The Provider's total liability is limited to the amount of subscription fees paid by the Photographer in the last 12 months.
8.1. The Photographer may cancel their account at any time in account settings.
8.2. The Provider may terminate the account with 30 days' notice in case of serious violation of these Terms.
8.3. After account cancellation, all data will be deleted within 30 days.
9.1. These Terms are governed by the laws of the Czech Republic.
9.2. Any disputes shall be resolved by the competent court in the Czech Republic.
